By accessing or using Brainstorm AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, you may not use the Service.
Who Can Use Our Service: - You must be at least 18 years old - You must provide accurate registration information - You must not be prohibited from using our Service under applicable laws - You must comply with all local laws regarding online conduct
Changes to Terms: We may modify these Terms at any time. We'll notify you of material changes via email or through the Service. Your continued use after changes become effective constitutes acceptance.
2. Account and License
Account Creation: - You're responsible for maintaining account security - You must provide accurate and complete information - You may not share your account with others - You must notify us immediately of any security breaches
License Grant: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to: - Use the Brainstorm AI MCP server - Install the WordPress plugin on your sites - Access our documentation and resources - Use our API within rate limits
License Limitations: You may NOT: - Reverse engineer, decompile, or disassemble our software - Redistribute or resell our Service - Remove proprietary notices or labels - Use our Service to violate laws or regulations - Share license keys with unauthorized parties
3. Subscriptions and Payments
Free Trial: - 7-day free trial on all plans - No credit card required to start - Full access to features during trial - Cancel anytime during trial with no charge
Paid Subscriptions: - Starter Plan: $19/year - For individual developers - Agency Plan: $199/year - For agencies and teams - All prices in USD, billed annually - Automatic renewal unless cancelled
Payment Processing: - Processed securely through Lemon Squeezy - We don't store credit card information - Payments are non-refundable except as required by law - Failed payments may result in service suspension
Refunds: - 30-day money-back guarantee (first purchase only) - Request refunds at [email protected] - Refunds processed within 5-7 business days - Access revoked upon refund
4. Acceptable Use Policy
You agree NOT to use the Service to:
Prohibited Activities: - Violate any laws or regulations - Infringe on intellectual property rights - Transmit viruses, malware, or harmful code - Attempt unauthorized access to systems - Spam, phish, or engage in fraudulent activities - Harass, abuse, or harm others - Impersonate others or misrepresent affiliations
Fair Use: - API rate limits apply (see documentation) - Don't overwhelm our servers with excessive requests - Don't create multiple accounts to abuse trials - Don't share license keys publicly - Use automation responsibly
Consequences: Violation may result in: - Warning and request to cease activity - Temporary suspension of service - Permanent termination of account - Legal action if necessary
5. Disclaimers and Limitations
Service "As Is": The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including: - Merchantability - Fitness for a particular purpose - Non-infringement - Uninterrupted or error-free operation
Your Responsibility: - Backup your WordPress sites before using our Service - Test changes in staging environments when possible - You're responsible for your site's content and security - We're not liable for damage to your WordPress sites
Limitation of Liability: To the maximum extent permitted by law, Brainstorm AI shall not be liable for: - Indirect, incidental, or consequential damages - Loss of profits, data, or business opportunities - Damages exceeding amount paid in last 12 months - Issues caused by third-party services or your misuse
Third-Party Services: We integrate with WordPress, page builders, and other services. We're not responsible for: - Changes to third-party APIs or compatibility - Third-party service outages or data loss - Third-party terms or privacy policies
6. Intellectual Property
Our Property: The Service, including software, documentation, branding, and content, is owned by Brainstorm AI and protected by: - Copyright laws - Trademark laws - Trade secret laws - International treaties
Your Content: - You retain ownership of content you create - You grant us license to host and display your content - You're responsible for your content legality - We may remove content that violates these Terms
Open Source: - Our software includes open-source components - GPL-2.0+ license applies to applicable components - Third-party licenses are respected and documented - See our GitHub repository for details
7. Termination
You Can Cancel: Anytime through your dashboard or by contacting support. Access continues until end of billing period.
We Can Terminate: If you violate these Terms, with or without notice. Refunds at our discretion.
Effect of Termination:
- License to use Service is revoked
- Access to account and data is terminated
- Data may be deleted after 30 days
- Provisions that should survive termination will survive
8. Governing Law and Disputes
